Both parents retain parental responsibility for the children. Whatever the dispute between the parents, the courts will endeavour to ensure that the children have a relationship with both parents but will make decisions about where the children should live and how often they should have contact with the absent parent. They will also look at issues that arise if the children are to move some distance away from where they previously lived and make orders if the children are to move out of the country.
The courts will also deal with similar issues where the parents are not married.
Again we offer free or fixed fee interviews and will consider with you a “pay as you go” package as well as our traditional hourly rates service. A “fixed fee” may not be suitable for this area as everyone’s requirements are different.
Legal aid is available for these disputes but only in very limited circumstances and we would consider this with you in the free interview.
